Since Android is based on Linux, dosen't that mean that Google is leagally required to give us the source code?

The GNU license stipulates that companies are allowed to distribute and change Linux, but the customers have to be able to have access to the source code.

The source code to the parts of Linux they use, not the proprietary software they added to make the phone actually work.
Its the same with Apple. You can download Darwin sources (the *nix parts of Mac OSX), compile it and run it but it is nowhere near what Mac OSX is.
